Energy industry associations launch arbitrage body

The Indonesia Energy Arbitrage Agency (or Badan Arbitrase Sengketa Energi Indonesia/BASE) was officially established on Friday to help resolve disputes in the energy industry.

BASE emphasized that energy disputes require arbitrators who are qualified and competent in energy-related matters.

BASE was founded by several energy industry-related associations, including APMI (Association of Indonesian Oil, Gas and Geothermal Drilling Companies), APHMET (Association of Oil and Gas and Renewable Energy Law Practitioners), APLSI (Indonesian Private Power Producers Association), AESI (Indonesian Solar Energy Association), and the Indonesia Mining Association (IMA).

"BASE is not just an additional arbitration agency alongside existing ones. It is a pioneer in Indonesia’s energy arbitration," said Jou Samuel Hutajulu, Chairman of BASE, on Friday.

Jou Samuel noted that BASE’s arbitrators are energy industry practitioners with a deep understanding of the sector. "This is aimed at providing more relevant and effective dispute resolutions," he explained.

In the era of energy transition, BASE anticipates a rise in energy-related disputes. An example is the Power Purchase Agreement (PPA) conflict between Independent Power Producers (IPP) and state-owned electricity firm PT PLN (Persero) regarding the early retirement of coal-fired power plants.

BASE will handle disputes across various energy sectors, including oil and gas, electricity, mining, and renewable energy.
